Terms of Use (End User License Agreement)
These Terms of Use (“Terms”) are a legal agreement between you and Maryna Yankevych, a self-employed individual registered in Cyprus (“we”, “us”), governing your use of the DemetRUN mobile application (“App”). By using the App you agree to these Terms. If you do not agree, do not use the App.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, as permitted by the Usage Rules of the Apple Media Services Terms and Conditions, for your personal, non-commercial use.
2. A game, not medical advice
DemetRUN is a game. Its hints about training load, run types and recovery, and the farm's “weather”, are game mechanics, not medical, health or coaching advice, and do not replace a doctor or a qualified coach. Consult a doctor before starting or changing an exercise programme, especially if you have a health condition. Train within your limits and stop if you feel unwell. You are responsible for how and where you exercise, including traffic and weather.
3. Eligibility and accounts
You can play on your phone without an account. The cloud features (account, backup, friends) are for users aged 16 or older, or younger where a parent has consented and local law allows. If you create an account, keep your sign-in method secure; you are responsible for activity under your account.
4. Friends and names
Your farm name and your hen's name are visible to the friends you share your farm code with. Do not use names that are offensive, hateful, impersonate someone else or infringe others' rights. We may change such a name or suspend the cloud features of an account that breaks this rule.
5. In-game items
Energy (⚡), coins (🪙), seeds, crops, buildings and other in-game items have no monetary value, cannot be bought or sold for real money, and cannot be transferred or redeemed. They are earned only by playing. They exist as part of the game and your license to use it.
6. Subscriptions (DemetRUN+)
Version 1.0 contains no purchases. When DemetRUN+ becomes available, the following applies:
- DemetRUN+ is an auto-renewable subscription sold through the App Store; payment is charged to your Apple ID at confirmation of purchase.
- It renews automatically at the then-current price for the same period unless cancelled at least 24 hours before the end of the current period. If a free trial is offered, it converts to a paid subscription at its end unless cancelled at least 24 hours before.
- You can manage and cancel it in your Apple ID / App Store settings. Deleting your DemetRUN account does not cancel the subscription.
- Price increases are notified in advance and, where Apple's rules require, need your consent.
- Refunds, including the 14-day right of withdrawal for EU consumers, are handled by Apple under its refund process.
- Current prices, periods and any trial are shown in the App before you buy. DemetRUN+ gives cosmetic and convenience features only; it never sells in-game currency or advantages in leagues or duels.
7. Acceptable use
You agree not to: use the App unlawfully; attempt to access other players' data, break security or disrupt the service; manipulate the game with fake Health data in order to affect other players' leagues or duels; or reverse engineer, decompile or resell the App except where the law expressly permits.
8. Privacy
Your use of the App is also governed by our Privacy Policy.
9. Service availability
The game runs on your phone; cloud features (backup, friends, sign-in) may occasionally be unavailable. We may change, suspend or discontinue features. If we shut down the cloud service, we will give reasonable notice so you can export your data.
10. Disclaimers
To the maximum extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind. Nothing in these Terms limits consumer rights that cannot be excluded under applicable law.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages or loss of profits, and our total liability for all claims relating to the App is limited to the amounts you paid us for the App in the 12 months before the claim arose, or €50, whichever is greater. Nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, fraud, gross negligence or wilful misconduct. Mandatory consumer rights in your country of residence remain unaffected.
12. Termination
You may stop using the App and delete your account at any time (Settings → Account → Delete account); you can export your data first. We may suspend or terminate cloud access if you materially breach these Terms, notifying you first where reasonably possible.
13. Apple-specific terms
Because you obtained the App through the Apple App Store:
- These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content.
- We, not Apple, are responsible for maintenance and support. Apple has no obligation to provide any. Support: support@demetrun.com.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
- Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability, legal or regulatory, and consumer-protection claims.
- Apple is not responsible for investigating, defending, settling or discharging any third-party claim that the App infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
14. Governing law
These Terms are governed by the laws of the Republic of Cyprus, without prejudice to the mandatory consumer-protection rights of the country in which you live.
15. Changes
We may update these Terms. Material changes will be announced in the App at least 30 days before they take effect; continued use after that date means you accept them.
16. Miscellaneous
If any provision is held invalid, the rest remains in force. We may assign these Terms as part of transferring the App to a legal entity through which it is operated; your rights will not be reduced by such a transfer. Demeter, Zeus and the rest of Olympus appear in the App as characters of Greek mythology; DemetRUN is not affiliated with any sporting organisation.
